SWJ Transportation settles lawsuit brought by injured woman

Maribel was driving her Nissan Altima southbound in the right-hand lane of S. Main in Pearland, Texas, when she struck the rear of a flatbed trailer being towed by SWJ Transportation. The truck driver had parked the 18-wheeler in the right-hand lane of the roadway and entered a store. Maribel suffered very severe orthopedic injuries to her face, hips, and legs.The 18-wheeler had insurance in the amount of $1,000,005. The insurance company denied Maribel’s claim, offering her nothing. Maribel hired our firm to pursue her claim for her.We filed the case in Brazoria County, Texas. Through document discovery and deposition testimony, we established that the SWJ Transportation driver parked the 18-wheeler illegally, violated the Texas Motor Carrier Safety Regulations in failing to place warning devices behind the 18-wheeler, and violated the trucking regulations in having improper warning flags attached to the flatbed trailer.

We were successful in recovering the maximum insurance amount of $1,000,005 on Maribel’s case.

$1,000,005 Settlement; attorney’s fees were $324,024.52 and expenses were $137,037.21
